What are Indian Powers of Attorney and how can we help?

An Indian Power of Attorney is a document that allows one person to make decisions or take actions on behalf of another person, especially in legal or financial matters. In India, a power of attorney is granted typically in relation to the sale of land, disputes over land or divorices.

There are mainly two types of Indian powers of attorney:

• General Power of Attorney (GPA): This type gives wide-ranging powers to the attorney, allowing them to handle various tasks like managing property, making financial transactions, and representing the principal in legal matters.

• Special Power of Attorney: This type is limited to particular tasks or transactions. For instance, it may be used for selling a specific piece of property or signing a specific contract.

Indian powers of attorney take many different shapes and sizes and have different execution requirements depending on the state in India that it is to be used. These requirements can include:

1. Legalisation by way of an Apostille;

2. Legalisation at the Indian High Commission;

3. Two witnesses in addition to the Notary;

4. Photographs attached to the power of attorney;

5. Fingerprints to be added next to the signature.
